What Are The Pros And Cons Of Employment At Will Doctrine?

Employment-at-will doctrine is a kind of employment agreement exercised by some organizations wherein the employers may terminate the employees anytime with or without any justification or reason or at the will of the employers without prior notice. On the other side, the employees also may leave their work anytime whenever they wanted to.

Here are some pros for this employment-at-will:

There will be a flexible employment contract between the management and the workers; which means that there will be more opportunities that the workers can choose to whenever he/she is no longer comfortable in the organization and find a better options of jobs he/she is comfortable with. On the employer's side, they can easily terminate and promote employees who have a poor and excellent performance.

The employer can focus on the merits of each worker and can easily determine the specific training and evaluation to the employees.

It also reduces binding issues between the management and the employees thus creating more flexible relationship with the two parties (employers and employees).

Here are some cons for this employment-at-will:

1. The employer will always train new workers for a specific job that has been left by a previous worker and entails additional cost for the trainings and it may affect on the efficiency of the performance when there will be new employee because it has to take time to be fully familiar with the new assignment.

2. The employer's decision to terminate the employee may create less stability of the workforce since the employees have to adjust on the behavior and attitude of their new co-workers and there might a gap on the targets to be achieved.

3. There will be more conflicts arising in the workplace because of stress and more competitions in the job. This may create non-cooperation in the workplace thus affecting the efficiency of the workers.

However, when implementing with this employment-at-will doctrine, there will be also a consideration of some legal policies like the anti-discrimination and racial discrimination law. There are also other common-law that should be developed in the workplace. With this kind of employment, there are reviews - that the number of cases on the "wrongful demotion" has been increasing in the past few years. This is so sad! Knowing that anytime you will be one of the unemployed individual - having a hard time in life and starting a job over again.
